A BATTLING pensioner who refused to give up in his fight to make Barnsley Council pay for the damage caused to his car after it hit a pothole has finally won his case.

Malcolm Cartwright says his victory is ‘a win for the little guy’.

Not only has the council had to pay him the £140 for the damage - but also his legal costs.

The 73-year-old former miner refused to accept repeated claims by the council that the road surface on Redbrook Road near his home had not been at fault.

“To be honest I felt they were treating me with utter contempt, they just repeatedly refused to accept liability when it was blindingly obvious the council was in the wrong and not me,” he said.

“It’s a victory for the little guy and it’s a victory for common sense.

“My advice to anyone else in a similar situation is don’t be intimidated and don’t give up.”
