BARNSLEY North MP Dan Jarvis is proposing a new law which is designed to close a legal loophole and help the government ‘deport more terrorists and extremists’.

The power to deprive someone of their British citizenship is an essential tool which the government uses to remove individuals who pose a national security threat such as terrorists, extremists and serious criminals from the country.

Until their British citizenship is removed, these individuals can enter and leave the UK freely.

Once it is removed, they will be permanently excluded from the country. However, those who have their citizenship removed have a right to appeal the government’s decision in the courts. Currently, if the courts agree with their appeal, they will have their citizenship reinstated immediately even if the government remains convinced that they are a threat and decide to appeal the court’s decision.

Under Dan’s capacity as Security Minister, he has backed a new law which will close this loophole. His Deprivation of Citizenship Orders (Effect During Appeal) Bill will ensure that citizenship is not automatically reinstated after a successful appeal until all further appeals are exhausted.

This will mean individuals cannot denounce other citizenships while the appeals process is ongoing. MPs will vote on Dan’s bill on Monday.

He said: “I’ve met families torn apart by terrorism and I hope that by closing this legal loophole we can stop more families going through this pain.

“My deprivation bill will mean that, when a court rules in a deprived person’s favour, their British citizenship will only be reinstated after all the appeals are completed not just their very first appeal.
